These terms are written in plain language on purpose. Most of them read like a conversation; a few read like a contract, because they are one. By tapping “I agree” in the app, or by using MusicMood, you accept all of them.
MusicMood is a personal listening companion, built and operated by its independent developer, Matthew Harkless (called “the developer” below). It watches the now-playing notifications from your music apps, analyzes the songs you play with AI, and builds insights about your listening and mood over time. It is meant for your own personal, informational use. You must be at least 13 years old to use it.
MusicMood is an entertainment, personal lifestyle, and reflection tool. Mood summaries, stress estimates, and every other insight in the app are AI-generated observations meant for reflection and entertainment. They are not medical, psychological, diagnostic, or therapeutic advice, and they are not a substitute for professional care. The app’s personas, including the one called “Therapist,” are AI characters, not licensed professionals. The app does not monitor for emergencies and will not detect a crisis. If you are struggling, please talk to a qualified professional. In the US, you can call or text 988 (the Suicide and Crisis Lifeline) at any time.
MusicMood is built to be passive: it captures your listening in the background with no interaction needed. You agree never to interact with the app while driving or operating machinery or a bicycle - no tapping, reading, or configuring until you are safely stopped. You are solely responsible for complying with traffic laws. To the fullest extent the law allows, the developer accepts no liability for accidents, citations, or injuries connected to using a device while in motion.
Your listening history, journal entries, and health signals stay on your device except for the specific, documented calls to the AI service described in the Privacy Policy. You can export your data to a file and delete it at any time. Files you export are in your care: anywhere you copy or share them is outside the app’s control.
Song analyses and mood insights are generated by AI. They can be inaccurate, incomplete, or just plain odd. Enjoy them, push back on them, but do not rely on them for important decisions.
Lyrics shown in the app are third-party content fetched from community sources for your personal, on-device viewing. Journal entries, notes, and anything else you write belong to you. When you choose to share or export something from the app - a lyric card, a mood card, a data export - that is your action and your responsibility. You agree to share only in ways that respect other people’s rights, and you agree to indemnify the developer (that is, cover the costs of claims against the developer) if content you selected and shared causes a third-party claim, including copyright claims over shared lyrics.
Some features may require a paid subscription. All purchases go through Google Play, and the developer never sees or stores your payment details. Subscriptions renew automatically until you cancel them in your Google Play subscription settings; cancellation takes effect at the end of the current billing period. Refunds follow Google Play’s refund policy. Prices can change; you will get notice and a chance to cancel before a change applies to you.
MusicMood talks to third-party services to do its job: Google’s Gemini AI for analysis, MusicBrainz for song metadata, lyric and weather services, and your own music apps for playback information. Those services have their own terms, and their availability is not something MusicMood can guarantee.
Use MusicMood for yourself. Don’t attempt to abuse, overload, probe, or reverse engineer the services behind it, don’t try to bypass usage limits, and don’t use its output in ways that violate someone else’s rights or the law.
The app, its code, design, branding, and the analysis formats it generates are the developer’s intellectual property. Your personal data and your writing are yours. If you send feedback or ideas, the developer may use them without obligation to you.
MusicMood is provided as-is, and this is early software. Songs may be misidentified, analyses may fail, and data loss is possible despite best efforts. Export a backup of anything you would hate to lose.
To the fullest extent the law allows: the developer is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or device problems arising from your use of the app. For any claim, the developer’s total liability is capped at the greater of (a) the amount you paid for MusicMood in the 12 months before the claim arose and (b) 50 US dollars. Some places do not allow some of these limits, so parts of this section may not apply to you.
Please read this section carefully. It affects your legal rights, and it is intentionally the most formal part of these terms.
You and the developer agree that any dispute arising out of or relating to MusicMood or these terms will be resolved by BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than by a court, except that either of us may bring an individual claim in small claims court. The Federal Arbitration Act governs this section. Arbitration is conducted in English by a single arbitrator, and AAA’s consumer rules control filing fees and hearing location.
CLASS ACTION WAIVER: you and the developer each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding.
Opt-out: you may reject this arbitration section, without affecting the rest of these terms, by emailing support@harkcode.app with the subject “Arbitration opt-out” within 30 days of first accepting these terms.
These terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs section 13. If any part of these terms is found unenforceable, the rest stays in effect. These terms are the entire agreement between you and the developer about the app.
You can stop using MusicMood at any time by uninstalling it. The developer may suspend or end access to the app’s online services (such as AI analysis) for abuse of these terms, and may discontinue the app or its services, with reasonable notice where practical.
These terms may change as the app evolves. For meaningful changes, the app will show you the updated terms and ask you to accept them again. Continuing to use the app after accepting means the updated terms apply.
